Terms of Service

These Terms of Service (“Terms”) govern your access to and use of followupforge.com and its subpages (the “Site”), and your purchase and use of Follow Up Forge (the “Product” or “the System”). The Site and Product are operated by Padasevana LLC (“Padasevana,” “we,” “us,” or “our”).

By accessing the Site, purchasing the Product, or clicking to accept these Terms, you agree to be bound by them. If you do not agree, do not use the Site or purchase the Product.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to purchase the Product or create an account. By using the Site, you represent that you meet these requirements.

3. The Product

Follow Up Forge is a digital product for course creators, coaches, and consultants. It includes pre-written email sequences, CRM setup training, and an AI voice profile system, along with any materials, templates, files, and resources we make available to you as part of your purchase.

The Product is delivered electronically. You are responsible for having the equipment, software, and internet access needed to receive and use it. We may update, improve, or change the contents of the Product over time.

4. License to use the Product

When you purchase the Product, we grant you a limited, non-exclusive, non-transferable, revocable license to use the materials for your own business and the businesses of your direct clients, subject to these Terms.

You may:

• Use the email sequences, templates, and training to build and run follow-up marketing inside your own business.
• Adapt and customize the templates for your own campaigns and, if applicable, for clients you serve directly.

You may not:

• Resell, sublicense, redistribute, share, or give away the templates, sequences, training, or any other Product materials as standalone files or content.
• Repackage the Product, in whole or in part, into a competing product, course, template pack, or swipe file offered to others.
• Post the Product materials publicly or in any shared library, membership, or repository where others can download them.
• Use the Product in any way that infringes our intellectual property or these Terms.

The license is for the materials as we provide them. It does not transfer ownership. We retain all rights not expressly granted to you.

5. Pricing and payment

Prices are listed on the Site and are in U.S. dollars unless stated otherwise. We may change prices at any time, but changes will not affect orders already completed.

Payments are processed by third-party payment processors. We do not store full payment card numbers on our systems. By submitting payment information, you authorize us and our processor to charge the amount shown for your order, plus any applicable taxes.

You are responsible for any taxes that apply to your purchase based on your location.

6. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

7. Intellectual property

The Site, the Product, and all content we provide, including text, copy, templates, sequences, training materials, graphics, logos, and design, are owned by Padasevana LLC or our licensors and are protected by copyright, trademark, and other laws.

“Follow Up Forge” and “Padasevana” and associated logos are marks of Padasevana LLC. Nothing in these Terms grants you the right to use our marks without our prior written permission.

8. Your responsibilities and acceptable use

You agree to use the Site and Product lawfully and to comply with all applicable laws, including marketing, anti-spam, and data protection laws (for example CAN-SPAM, and where relevant CASL or GDPR) when you send emails using sequences built from the Product.

You are solely responsible for the messages you send, the lists you send to, and obtaining the consents required to contact your recipients. We do not send email on your behalf and we are not responsible for how you deploy what you build.

You agree not to:

• Access the Site or Product through unauthorized means, including scraping, automated harvesting, or circumventing access controls.
• Interfere with or disrupt the Site, servers, or networks.
• Attempt to gain unauthorized access to any account, system, or data.

9. Third-party services and links

The Site and Product may reference or link to third-party tools, platforms, and websites (for example CRM and email platforms, payment processors, and hosting providers). We do not control those services and are not responsible for their content, availability, terms, or practices. Your use of any third-party service is governed by that party’s own terms.

10. Disclaimers

The Product is educational. Your results depend on factors we do not control, including your effort, market, offer, list, and execution. Please read our Disclaimer, which forms part of these Terms.

To the fullest extent permitted by law, the Site and Product are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or Product will be uninterrupted, error free, or will produce any particular outcome.

11. Limitation of liability

To the fullest extent permitted by law, Padasevana LLC and its members, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or Product, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability to you for all claims relating to the Site or Product will not exceed the amount you paid us for the Product in the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Padasevana LLC and its members, officers, employees, and contractors from any claims, damages, liabilities, costs, and expenses, including reasonable legal fees, arising out of your use of the Site or Product, your violation of these Terms, or your violation of any law or the rights of any third party, including how you use the Product to contact your own recipients.

13. Termination

We may suspend or terminate your access to the Site or Product if you breach these Terms. On termination, the license granted in Section 4 ends and you must stop using and delete the Product materials, except where law requires otherwise. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and indemnification.

14. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law rules. You agree that any dispute arising from these Terms or your use of the Site or Product will be resolved in the state or federal courts located in Wake County, North Carolina, and you consent to the jurisdiction of those courts.

Before filing any claim, you agree to first contact us at support@followupforge.com and attempt to resolve the matter informally in good faith.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date above. Continued use of the Site or Product after changes take effect means you accept the updated Terms.

16. Miscellaneous

If any provision of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, Refund Policy, Disclaimer, and Cookie Policy, are the entire agreement between you and us regarding the Site and Product.
